Represented Nestlé Waters North America Inc. in a putative class action brought by seven route salespeople seeking to represent a class alleging FLSA, age and race discrimination claims against our client. The firm defeated an attempt to obtain certification of a multi-state wage/hour collective action in the Southern District of Florida, limiting the dispute to a small area. Summary judgment was obtained on most of the remaining claims and a favorable settlement was obtained for the rest of the claims.

Smith v. Nestlé Waters North America, Inc., No. 05-CV-80018 (S.D. Fla. filed Jan. 11, 2005).
