Represented an individual and his five franchises, as plaintiffs, in a lawsuit against defendant regarding alleged violations of a non-competition covenant in the franchise agreements. The trial court granted summary judgment in favor of plaintiffs, finding that the non-competition covenants were void as a matter of law. This ruling was affirmed by the Georgia Court of Appeals. The Georgia Supreme Court unanimously affirmed the trial and appellate court decisions and rejected all of defendants arguments. A jury trial is requested for August or September 2009 to determine damages.
