On August 1, 2007, the United States Trademark Office published new rules amending various procedures for litigating matters before the Trademark Trial and Appeal Board. Some of these amended rules have already gone into effect, and others will be effective on November 1, 2007. Kilpatrick Stockton partner Bill Bryner will discuss these amended rules and their impact on both pending and new inter partes proceedings before the TTAB. Topics will include:

  • The amended rules' approach to protective orders in TTAB proceedings;
  • The new requirements regarding "service" of initial pleadings;
  • The "modified disclosure regime" adopted by the amended rules; and
  • Related procedural matters.
